Motion Cypher — Terms of Sale

Effective Date: 31 August 2026
Last Updated: 31 August 2026

These Terms of Sale (“Terms”) apply to purchases of physical books made through the Motion Cypher website (“Website”).

By placing an order through the Website, you agree to these Terms. These Terms apply specifically to the purchase of physical books and are separate from the rules governing Motion Cypher games, competitions and other activities.

1. About Motion Cypher

Motion Cypher is a UK-based creative project producing and selling visual puzzle books and other physical publications.
These Terms govern purchases made directly through the Motion Cypher Website.
Our contact email for orders and customer service is:

Orders@motioncypher.com

2. Products

We make every reasonable effort to ensure that product descriptions, photographs and other information displayed on the Website accurately describe the books offered for sale.
Books are physical printed products and may contain minor variations in colour, printing or appearance that do not materially affect the product.
Unless otherwise stated, books sold through the Website are standard, non-personalised products.
All products are subject to availability.

3. Placing an Order

When you place an order through the Website, you are making an offer to purchase the selected book(s). After placing an order, you will normally receive an order confirmation by email acknowledging that your order has been received. The contract between you and Motion Cypher is formed when we accept your order and confirm that the book(s) are available for dispatch. We reserve the right to decline or cancel an order where, for example:

  • The product is unavailable;

  • There has been an obvious pricing or product-description error;

  • We are unable to fulfil the order;

  • We reasonably suspect fraudulent or unauthorised activity; or

  • There is another legitimate reason preventing us from fulfilling the order.

If we cancel an order after payment has been taken, you will receive a full refund for the cancelled order.

4. Prices and Payment

The price payable for a book will be the price displayed on the Website at the time the order is placed, unless there is an obvious error. Prices and applicable delivery charges will be displayed during the ordering process before payment is completed. Payment is taken when an order is placed. For pre-orders, payment is also taken at the time the pre-order is placed rather than when the book is subsequently dispatched.

5. Pre-Orders

Some books may be offered for pre-order before they are available for dispatch.
Where a book is available for pre-order, the Website will provide an expected release or dispatch date where reasonably possible.
Pre-order dates are estimates and may change due to circumstances such as printing, manufacturing or supply delays.
You may cancel a pre-order at any time before it has been dispatched by contacting:

Orders@motioncypher.com

A cancelled pre-order will receive a full refund.
Once a pre-order has been dispatched, the normal cancellation and returns provisions will apply.
If we are unable to fulfil a pre-order, we will notify you and provide a full refund.

6. Data Collection and Handling

  • When you place an order, we collect personal data such as your name, email address, and order details. This is processed under the lawful basis of Performance of a Contract, allowing us to fulfil your order, provide access to digital content, and send relevant order communications.
  • All collected data is handled in accordance with standard data protection principles and is stored securely using encrypted protocols where applicable. No personal data is sold, distributed, or misused under any circumstances.
  • Certain data is also retained to meet our Legal Obligations, including accounting and tax record-keeping

7. Delivery

We dispatch orders from the United Kingdom using postal and delivery services appropriate to the destination, which may include Royal Mail.
Delivery estimates are provided for guidance and are not guaranteed unless expressly stated otherwise.
Once your order has been dispatched, delivery times may be affected by circumstances outside our control, including postal delays, customs processing, adverse weather, industrial action or other disruptions.
You are responsible for providing an accurate and complete delivery address when placing your order.
If an order cannot be delivered because an incorrect or incomplete address was provided, additional delivery or return costs may apply.
For international orders, delivery may take longer than the estimated timeframe for UK orders.

8. International Orders

We accept orders from customers outside the United Kingdom.
International deliveries may be subject to customs procedures, import duties, taxes or other charges imposed by the destination country.
Unless expressly stated otherwise at checkout, any such charges are the responsibility of the customer.
Customers are responsible for ensuring that the ordered products can legally be imported into their destination country.
International delivery times are estimates only and may be affected by customs processing or other circumstances outside our control.
Nothing in these Terms excludes or limits any mandatory consumer rights that apply to you under the laws applicable to your purchase.

9. Cancellation, Returns and Refunds

Your rights to cancel an order, return a book and receive a refund are explained in our Returns & Refunds Policy.
For UK customers purchasing online, statutory cancellation rights may apply to eligible purchases.
If you wish to cancel, return or request a refund, please contact:

Orders@motioncypher.com

Please do not send a book back without contacting us first. We may need to provide return instructions and, where appropriate, request photographs of the book and its packaging before a return is arranged.

Nothing in these Terms or our Returns & Refunds Policy affects your statutory consumer rights.

10. Damaged, Faulty or Incorrect Products

If a book arrives damaged, faulty, defective or is not the book you ordered, please contact us at:

Orders@motioncypher.com

Please provide your order number and, where possible, photographs of the book and packaging.
We will assess the issue and, where appropriate, arrange a replacement or refund in accordance with your statutory rights and our Returns & Refunds Policy.
Where a return is required because a book is faulty, damaged or incorrectly supplied, we will provide appropriate instructions for returning the item.

11. Ownership and Intellectual Property

When you purchase a physical Motion Cypher book, you acquire ownership of that physical copy.
Purchasing a book does not transfer copyright, intellectual property rights or other rights in the content to you.

The Motion Cypher Website and its contents, including text, graphics, photographs, logos, designs and other materials, are owned by or licensed to Motion Cypher unless otherwise stated. You may use the Website for personal and lawful purposes. You must not copy, reproduce, modify, distribute or commercially exploit Website content without our permission, except where permitted by law.

14. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Nothing in these Terms affects your statutory consumer rights.
Subject to those rights, Motion Cypher will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.

15. Privacy

Personal information provided when placing an order is handled in accordance with our Privacy Policy.
We may process information such as your name, delivery address, email address and order details for purposes including processing your order, taking payment, arranging delivery, providing customer support and complying with legal and accounting obligations.

We may update these Terms from time to time.
The version applicable to your purchase will be the version in effect when you place your order, unless a change is required by law or applies to an ongoing arrangement.
The latest version will be published on the Website.
